ALLOCATION OF OFFICIAL CONSTRUCTION WORK
The statistical data that the Cámara de Contratistas de Castilla y León frequently publishes refer exclusively to official construction work for which Public Administrations within the territory of our autonomous community invite tenders.
Said data are calculated on the Opening Date of the quotes, the point at which the Public Administrations are obligated to decide on the matter. Until then, the Public Administrations can annul or modify any official announcement made, and consequently the data obtained prior to the opening may not be definitive.
If the tender process is based on ‘open economic criteria’ (old invitation to tender) and several bids have been submitted, the Public Administration must award the construction work to the bid offering the lowest cost amongst all of those submitted that complies with the requirements legally set forth. If no bids are submitted, the Public Administration must declare the construction work void, and shall be able to suspend the execution of the construction work or issue a new invitation to tender.
If the tender process is based on ‘several criteria’ (old invitation to tender) and various bids are submitted, the Public Administration, after examining and assessing such, must award the construction work to the bid that, pursuant to the objective awarding criteria set forth in the administrative specifications, is most advantageous to the contracting Public Administration.
However, it also has the authority to declare it void if none of the bids submitted satisfactorily meet the expectations of the contracting Public Administration or if no bids are submitted. If the tender is declared void, the Public Administration can suspend the execution of the construction work or issue a new invitation to tender.
